Ecommerce Europe – together with the online industry – raised its concerns during the last stakeholder consultation issued by Jan-Philipp Albrecht MEP, the Parliamentiary rapporteur on Data Protection. The proposed regulation will replace the 95/46/EC Data Protection Directive and make it future-proof for technological improvements with a regulation.
Ecommerce Europe asked MEP Albrecht to further specify the grant of profiling and targeting since this a fundamental component of e-commerce. The concerns also asked for clarification on the need for ‘once-only consent’ and the lawfulness of data processing. The new regulation also includes a right to be forgotten. Ecommerce Europe thinks that such a right already exists in the current regulations and is therefore an unnecessary addition. Furthermore, Ecommerce Europe stressed that ‘data portability ‘could lead to distortions of competitiveness.
